Here is the latest update on the Overtime Case payout which was settled in August of 2016 where AFGE Local 12 was represented by Snider and Associates. The Class Action Implementation Group (CAIG) calculated the payments of individual awards and is in charge of the distribution of these awards.  

Again, yes this is legitimate case and it is NOT Spam or junkmail.  If you either accidently deleted the email, or you deleted it because you thought it was junk mail, or you never got the email and you think you should have received an individual award please go to:

I am sharing this update regarding the distribution report from the Class Action Implementation Group (CAIG) that once again this is not a scam, this is a class action case AFGE Local 12 won where we were represented by Snider and Associates.

If you receive an email from Class Action Implementation Group (CAIG)

 

1) yes it is legitimate, and

2) you have received some money from the overtime case, and

3) you need to fill out their paperwork if you want the award.

4) You always have the option of rejecting the award.

 

If you have any questions you will have to contact CAIG, they are the experts and neither the officers or stewards have any information.

 

Also, please understand over 5000 people have won an award so we cannot answer each and every one  of your questions.

 

Finally, if you have not received any information from CAIG and you think you are entitled to an award; you may want to check your SPAM or Junk email directory. It may have been sent there by mistake.

Yesterday, the company which is overseeing the distribution of checks in the AFGE Local 12 Overtime case,  Class Action Implementation Group, issued the first check from the settlement money for  $49,833.11 to AFGE Local 12 for our legal expenses in Arbitrator fees,  and transcript costs.  This will open the door for the distribution of checks to the bargaining unit employees covered by this case.

 

The amounts of the checks have been determined by several factors such as whether you testified in the case, whether you submitted paperwork to Snider and Associates to demonstrate that you worked overtime, (you did not have to testify or submit paperwork to receive a payment but you will not receive as much as those who did step up),  and how many quarters, (three month period), you worked at the Department of Labor during the time period in dispute which was approximately from August 2003 to August of 2016 when the final settlement was signed.  We cut off the minimum amount of work time to be eligible for a check to be at least eighteen months.

 

Sorry, we still don’t know when the checks will be issued. An email message will be issued to everyone who receives a check before they receive a check.  Please note that well over five thousand (5000) people are eligible to receive checks. Class Action Implementation Group is handling the distribution of these checks.

 

Once the checks are issued, you will be given a contact number from Class Action Implementation Group if you have any questions.  Please do NOT call the union office about the check as the Class Action Implementation Group calculated your payment, and if there are any issues, they will have to work with you regarding your payment.

As you may recall, the matter resolved this past August for a significant sum. The terms of the Settlement Agreement required the Agency to gather and then provide a significant amount of records to our attorneys, Snider & Associates. This information, which consists of millions of pieces of data, is necessary to determine which employees are eligible for a payment from the Settlement and for the firm to be able to perform calculations. The information took longer for the Agency to provide than anticipated, Snider and Associates just received the last of this data and they are currently processing the same.  It is expected the processing will be completed within the next several months and that eligible employees, both current and past, will then be contacted directly by the settlement implementation company. We have been receiving a number of calls and emails inquiring about the timeline for the distribution of the overtime award.  We are referring you back to Alex’s original email (below) discussing this matter.  Please pay particular attention to the highlighted information.  It is now the beginning of October, and we never anticipated payments being made at this point.  In fact, we have contracted with a distribution company whose sole business is to compute payments in class actions lawsuits. They will have to compute hours worked,  the amount due, the taxes to be withdrawn, etc. Distribution is not a simple process; we must leave it to experienced accountants.  The distribution company we have contracted with has been endorsed by the law firm of Snider and Associates.

 

When December rolls around, we should have more specific information regarding payout times.  Until December, we simply have no additional information.

1)    The Union will receive all the funds that it expended in this case including the fees for the Arbitrator, and transcripts. Therefore, in the end the case cost the union, AFGE Local 12, nothing. Please note Snidar and Associates took this case on contingency basis and therefore the firm was never paid by AFGE Local 12.

 

2)    The pool of those receiving the payout includes the entire current  AFGE Local 12 bargaining in the Washington D.C. Metropolitan Area, a little over 3000 people and former members of the bargaining unit who were in the national office at the time of the case from 2006 to present. We cannot exclude bargaining unit members who are not dues paying members of the union.

 

3)    Snidar and Associates is hopeful that the distribution of the payout will occur by December of 2016, we will let you know as soon as we have more information about how and when this process will take place.

 

I am sorry that I cannot provide you any additional information at this time, representatives from Snidar and Associates will be coming to the national office locations of the Department of Labor during the fall of 2016 to explain the entire process. Thank you for your continued patience.

Dear Members:

Please review the attached document carefully if you believe that you are eligible for the overtime case that the union filed in August of 2006.  The actual claim for time for the claim begins in August of 2003 going forward.

Changes in the notice – please review:

  1. You have until Friday June 27, 2014 to request your time records from DOL management to determine if you earned unpaid overtime.

  1. You have until Friday August 29th to file you claim with Snider and Associates, LLC. who are representing Local 12 and its bargaining unit members in this matter.

Again please review the attached document if you have any questions.
